In its meeting on March 22, 2024, the Bundesrat confirmed the law implementing the EU Directive on motor vehicle liability insurance. This implemented a compromise proposal from the Conciliation Committee after the law failed to gain a majority in the Bundesrat on February 2, 2024. After the Bundestag confirmed the compromise proposal of the Mediation Committee on February 23, 2024, the law can enter into force once it has been drawn up and promulgated.

The implementation of the EU directive on motor vehicle liability insurance in Germany contains additional national regulations as well as European requirements:

• Standardization of claims history certificates for insured persons to facilitate switching between insurers.
• Introduction of motor sports liability insurance. In future, keepers, owners and drivers of racing vehicles used at motorsport events must maintain a minimum sum insured for personal injury, property damage and other financial losses suffered by third parties, including spectators and other bystanders. The sum insured must meet the requirements of Section 5d of the Compulsory Insurance Act and applies to damage caused by the use of the racing vehicle at motorsport events and activities such as races, competitions, training sessions, tests and demonstrations.

The organizers of motor sport events must ensure that the insurance cover is included in their liability insurance. The DMSB will publish an amendment to its requirements for organizer liability insurance in the near future.

An organizer's liability insurance can be taken out directly with the insurance broker Dr. Ellwanger & Kramm when registering for the event via the DMSBnet. These insurances fulfill the requirements for motor sport liability insurance according to § 5 d PflVG. The DMSB will inform separately in another news item as soon as this option is available.
